Information about A-therapist and Relevant Terms

This Website and Services are delivered and operated by A-therapist, a UK-based company providing Speech and Language Therapy services in the UK and overseas.

References to “Appointment, Bookings or Orders” means the ability to book or schedule appointments via this Website, via scheduling page links to A-therapist’s online Booking System, or via communications with A-therapist directly via email, telephone or in-person.

References to “We”, “Us” or “Our” shall be references to A-therapist.

References to “You”, “Your”, “User(s)”, “the End User” or “Client” shall be references to the member or licensed user of this Website or the user of any A-therapist Services.

Reference to “Services” means the services, content systems and informative material made available to users of this Website and A-therapist services provided online or in-person at our various A-therapist clinics across the UK.  

References to “Terms”, “Agreement”, “Contract” and “End User License Agreement” or “EULA” mean the terms and conditions herein and any other terms that regulate Your use of this Website and the associated A-therapist Services.

References to “Website”, or “site”, means this website that you are currently using, and all sub-domains of this site (unless explicitly excluded by their own terms and conditions), connected software and services which are a part of the site, including A-therapist online Booking System pages and services.

These Terms and Conditions form a binding contract (“Contract”) between you, the Client or service User, with A-therapist. Your use of the Services are bound by these Terms and Conditions so please take the time to read them carefully and make sure you have understood them.

Website Access and Use


Access to and the use of this Website is licensed and permitted subject to the terms set out in this EULA, and We reserve the right to remove or amend access to or the functionality of the site and/or suspend or terminate Your use without notice or liability. We will not be liable if by any circumstance Our site is unavailable at any time or for any period. By accessing this Website You agree to be bound by these Terms.

If You do not agree to these Terms You should not use this Website or access or use any of the Services. You must accept and comply with these Terms. A-therapist may decline access, terminate or restrict Your access and use of this site in the event of non-compliance with any part of this EULA. This EULA together with general terms and conditions of A-therapist, updates, disclaimers, policies and rules regarding Your use of A-therapist services, collectively shape the Agreement between You and A-therapist concerning Your use of this Website.

To use this Website, You must acquire access to the World Wide Web, either directly or through devices that access web-based content, and pay any service and/or telephony fees in connection with such access. Additionally, You must provide all equipment required to make such connection to the World Wide Web.

On occasion, A-therapist may restrict access to some parts of or to the entire site.

This Website is licenced, not sold, to You for use only under the terms of this EULA. A-therapist reserves all rights in and to this Website, Services and all site content and materials which are not expressly granted to You.

Frequent Modifications made to this Website

We intend to update Our site on a regular basis, and may modify the content at any time and without notice. If needed, We may suspend access to the site or close the site indefinitely. Any of the materials on the site may be out-dated at any time, and We are under no obligation to make such materials up-to-date. 

Scope of Licence for Use of this Website

At present, this Website gives users access to a collection of online resources, including booking A-therapist services. Unless explicitly stated otherwise, any new feature that augments or enhances this Website shall be subject to this EULA and any additional terms and conditions that may be applicable. You acknowledge and agree this Website is provided "AS IS" and that A-therapist assumes no responsibility for the timeliness, deletion, miss-delivery or failure to store any user communications or personalisation settings.

Limits on Use of this Website

You are responsible for making all the necessary arrangements for You to have access to this Website. You are also responsible for ensuring that all persons who access this Website through Your internet connection are aware of these terms, and that they abide by them.

Reliance on Information Posted

Any information, materials and commentary posted on this Website are not intended to amount to advice on which reliance should be placed. A-therapist therefore rejects all liability and responsibility arising from any reliance placed on such materials by any visitor to Our site, or by anyone who may be informed of any of its contents.

Appointments and Services

You are able to Order and schedule Appointments or Services via this Website and the associated A-therapist online Booking System or via contacting A-therapist directly via email or telephone. All Appointments and Services will be with, or carried out by, a qualified Speech and Language Therapist (“Speech Therapist”, “Therapist”) who is registered with the Health and Care Professionals Council (HCPC). Appointments are subject to availability. If you request an appointment with a specific Speech Therapist, We will endeavour to honour your request, subject again to availability. A-therapist provides in-person Appointments and online Appointments and Services. Our in-person Appointments may be offered at one of our clinics in the UK or at Your chosen setting depending on availability and circumstance.

Orders for Services, Bookings and Appointments via this Website

Orders for Services and booking Appointments and Services are available to any person aged eighteen (18) or over. There are two (2) ways to access the Services: Self-paying and booking the Services via this Website, or booking Services via this Website following payment of Services invoiced.

Contracts for the supply of services, goods, digital content or information obtained from A-therapist through this Website or via direct contact are governed by the terms set out in this EULA. These are the terms on which We will accept orders, bookings and appointments for A-therapist services which can be booked via the site or via direct contact with A-therapist. Regardless, You are responsible and must make certain that the booking details on any Order and as entered onto the site are complete and accurate before you submit the Order. If you think that there is a mistake or changes are required, please contact Us immediately.

When you submit an Order to Us, this does not mean that your Order is accepted. Our acceptance of any Order will take effect when you receive acknowledgement and confirmation via email from A-therapist. If We are unable to provide You with the requested Services, We will inform You via email and We will not process the Order.

Your Booking will become binding on you when We contact you via email that We are able to provide you with the Services and have accepted your Order, at which point a contract will come into existence between You and A-therapist.

A-therapist does not warrant or guarantee that all Services listed or advertised may be available at all times. A-therapist reserves the right to withdraw or make changes to any Services which may be available via this site. We may need to amend or cancel your Order or any Appointment even after this has been confirmed and paid for due to circumstances beyond our control or due to unforeseen unavailability of A-therapist clinicians. A-therapist will not be held liable in these circumstances, but will attempt to rebook your appointment(s) to a mutually convenient alternative time or where no alternative is possible then, if such Services have been paid, which are subsequently cancelled, A-therapist will refund any amounts due (see Cancellation terms).

If any of the terms set out in this EULA conflict with any term of the Order, the Order will take priority. We shall assign an Order Number to the Order and this will be stated in Your Order confirmation email. Please quote the Order Number in all subsequent correspondence with Us relating to the Order.

If You do not pay Us for the Services when you are supposed to as set out in the Booking information, We may suspend provision of the Service or Appointment with immediate effect until you have paid Us all outstanding amounts. This does not affect Our right to charge you interest on any outstanding amounts, as set out below.

Changes to an Order or Terms

We may revise the terms of an Order periodically in the following circumstances:
a. changes in how We accept payment from You; 
b. changes in relevant laws and regulatory requirements; 
c. changes to the Services which are provided.

You may reschedule an Appointment at any time following Your Booking, excluding up to 24 Hours before the Appointment scheduled start time. You can reschedule an Appointment via the A-therapist online Booking System or by contacting Us via email. Where an amendment has been made in which the total cost of the Services has been changed, We will notify You of the amended cost.

If There Is a Problem with the Services

In the unlikely event that there is any problem with the Services provided through A-therapist please contact Us and tell Us as soon as reasonably possible.

As a consumer, you have legal rights in relation to Services not carried out with reasonable skill and care. Nothing in these Terms will affect these legal rights.

Referral Form and Health Form(s) and Accuracy

If you wish to receive Services from A-therapist, You, or relevant other(s), will be required to complete a ‘Referral Form’, which includes the completion of a treatment ‘Consent Form’, as well as other ‘Case History Form(s)’ as part of the Assessment process. A-therapist forms may require you to provide details of health/medical history which will be reviewed by your assigned Therapist.

You must complete forms as accurately and comprehensively as possible. If you fail to do so it may impact the advice given or the decisions made by the Therapist about your health and/or treatment. If you provide inaccurate, false or incomplete information to the Therapist, A-therapist will not be responsible for any consequences as a result.

 

Service Costs and Payment

The cost of Services will be set out in Our prices in force at the time We confirm your Order. Our prices may change at any time, but price changes will not affect Orders that We have confirmed with you. In addition to the cost of your Services, depending on the venue in which your Appointments are to take place, you may be required to pay for the Therapist’s travel time and mileage costs and any other associated costs, such as parking and road, bridge or tunnel toll charges.

Payment of Services must be settled and paid in full prior to or at the time of booking and, for online Orders, full payment will be taken once your Order is accepted and confirmed via email. We accept all major debit and credit cards as payment method when paying for Services.

If You do not settle payments in full that are due to Us by the payment due date, We may charge You annual statutory interest on the overdue amount, as stipulated by the Bank of England base rate. Such interest shall accrue on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You must pay Us interest together with any overdue amount. However, if You dispute an invoice in good faith and contact Us to let Us know promptly after You have received an invoice that You dispute it, the right to claim interest will not apply for the period of the dispute.

Suspension of Service and Acceleration

If any payment amounts are due or owing by You to A-therapist concerning any Services which you have Ordered, We may, without limiting Our other rights and remedies, accelerate Your unpaid fee obligations under such agreements so that all such obligations become immediately due and payable, and suspend the provision of all A-therapist Services to You until such amounts are paid in full.

Exercising your Consumer Right to Change Your Mind

As a consumer, You have a legal right according to UK legislation to ‘change your mind’ and cancel your Order within 14 days from receiving Your Order confirmation and acceptance email. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail below.

As a consumer, how long you have to change your mind depends on what you have ordered and how it is delivered.

  • To cancel an online purchase Order of A-therapist Services, You have 14 days after the day We email You to confirm We accept Your Order. However, if Services were carried out during the 14-day ‘cooling-off’ period, or You did not notify A-therapist of an Appointment cancellation giving the required minimum 24 Hours notice before Your Appointment start time, A-therapist will keep the necessary costs to cover the Services provided up until Your notice of Order cancellation was received and You will receive a partial refund for the remaining Services in Your purchase Order. 

  • You are not able to cancel and receive a refund for any online purchase Order of A-therapist Digital Content for immediate download or streaming. For subscription services, You will be able to receive a full or partial refund if You are within the 14-day ‘cooling-off’ period, subject to whether digital content has been downloaded during this period.

Your Rights to Cancel Or Reschedule an Appointment

Unless otherwise stated in your booking confirmation, the rules below on cancellation, rescheduling and any applicable charges shall apply to Your Booking.

Subject to the following terms, you have the right to cancel an Appointment, or reschedule an Appointment, and You can do so via the A-therapist online Booking System or by contacting Us via email.  

To cancel or reschedule an Appointment, You must notify A-therapist giving a minimum of 24 Hours notice prior to the start time of the Appointment your wish to amend. If You cancel an Appointment with less than 24 Hours’ notice or if You fail to attend your Appointment for any reason, no refund will be made. Longer minimum notice periods may apply to some Services and You should refer to Your booking confirmation for specific details on any additional Terms that may apply.

If You cancel an independently booked Appointment with over 24 Hours’ notice from the Appointment start time, We will refund the full amount to the payment card in which the payment was made within 14 days. Some Appointments may require a longer minimum notice period for cancelations or amendments. The specific Terms in Your Order confirmation will take precedence over the Terms stated in this contract.  

If Your Appointment was purchased and booked as part of a single payment transaction for a ‘Packaged Service’ (i.e. ‘Therapy Packages’), You will not be entitled to a refund due to any Appointment cancellations or missed attendance past Your 14-day ‘cooling-off’ period. However, You are able to reschedule Appointments if the original Appointment is not scheduled to take place within 24 Hours.

A-therapist clinicians reserve the right to accept or decline any request to reschedule an Appointment notified within 24 Hours’ of the Appointment start time at entirely their discretion. Depending on Service availability, You may be offered, with no guarantee, an alternative Appointment time which will be agreed upon between You and Your Therapist. If You again request to reschedule the alternative Appointment within 24 Hours of the Appointment start time, Your request to reschedule will be declined and the Appointment cancelled.  

Our Rights to Cancel or Reschedule and Applicable Refund

We may have to reschedule or cancel Your Appointment(s) due to an event outside Our control or the unavailability of the relevant A-therapist clinician. We will contact You via email as soon as possible if this happens. You are responsible for ensuring Your email inbox and Appointment notifications are checked prior to upcoming Appointments, including on the day of Your scheduled Appointment. You agree to respond in reasonable time to any communication from A-therapist to confirm receipt and acknowledgment of Your rescheduled or cancelled Appointment(s). 

We will always try to reschedule any Appointment(s) in the first instance, however, there is no guarantee that Your Appointment(s) can be rescheduled and thus cancellation may be necessary. You have the option to reschedule any Appointment(s) that have been scheduled by A-therapist as long as the Appointment you wish to amend is not scheduled to take place within 24 Hours. Any Appointment that has been rescheduled by A-therapist to take place within 24 Hours will only be scheduled after receiving Your confirmation to proceed.

If We have to cancel an Appointment and You have made any payment in advance, We will refund these amounts to the payment card, or method, in which the payment was made within 14 days.

Where You have scheduled a course of Appointments, and We have to cancel Your subsequent Appointments, We will provide a partial refund for the Appointments or Services that have been cancelled.

Consent to Treatment and Attending Appointments

In the UK, people aged sixteen (16) or over are entitled to consent to their own treatment. This can only be overruled in exceptional circumstances. Children under the age of sixteen (16) can consent to their own treatment if they are believed to have enough intelligence, competence and understanding to fully appreciate what is involved in their treatment. This is known as being Gillick competent. A-therapist will respect a person’s decision to cancel an Appointment(s) by them refusing attendance, or withdrawing consent to treatment, of any scheduled Appointment(s) if the Therapist has evidence to believe that the person is Gillick competent, regardless of any other person requesting an Appointment(s) to proceed. This does not affect the Terms stated in this Contract and it is Your responsibility to ensure that all competent persons are aware, and agree to, these Terms. This decision may be overruled in exceptional circumstances.

If a child under the age of sixteen (16) is not deemed Gillick competent, a person with parental responsibility can provide consent to treatment. By law, healthcare professionals only need consent from one person with parental responsibility to provide treatment to a child under sixteen (16) years of age. The person with parental responsibility must have the capacity to give consent. If a parent, or legal guardian, refuses to give consent, this decision can be overruled by the courts if treatment is believed to be in the best interests of the child. In an emergency, where treatment is vital and waiting for consent would place a child at risk, treatment can proceed without consent.

 

All adults are presumed to have sufficient capacity to decide on their own medical/health treatment, unless there is significant evidence to suggest otherwise. If a person lacks capacity to make informed decisions regarding their healthcare, consent to treatment can be given by a family member or close friend, or someone who has been given lasting power of attorney (LPA), or an independent mental capacity advocate (IMCA), who has the person’s best interests in mind. A person’s capacity can sometimes change over time or day-to-day. Therefore, Your Therapist will regularly review decisions to carry out any treatment in relation to a person’s capacity to consent, or withdraw consent, and the person will be involved as much as possible in the decision. To make any decision to commence or cease Services, a person’s capacity and best interests will always be considered.

Any Appointment(s) attended by a person believed not have capacity to provide their own legal consent to treatment, and including children under eighteen (18) years old, must be accompanied for the entirety of their Appointment(s) by an adult involved in their care. Preferably this should be an adult who is responsible for supporting therapy treatment outside of direct Appointments with the Therapist.   

The legal consent holder has the right to withdraw consent to treatment and the receiving of any A-therapist Services at any time and without reason by informing A-therapist via email, telephone or face-to-face. If not the legal consent holder, You also have the right to cease A-therapist Services at any time. This does not affect any other Terms stated in this Contract. We ask that You give Us a minimum notice period of 14 days for ceasing any or all Services. If consent to treatment or receiving of Services, including the sharing of any information, has been withdrawn from the legal consent holder, this will be taken into effect without delay once received and formal notice via email will be required.

A-therapist, and A-therapist clinicians, have the right to decline or cease Services at any time without providing reason or prior notice.

Late Attendance

If You are running late for an Appointment We would advise You to promptly contact and inform A-therapist via email, or Your Speech Therapist via email, telephone, or SMS/WhatsApp, as acceptable and agreed by Your Therapist. If You make contact or attend an Appointment more than fifteen (15) minutes late or do not attend Your Appointment, We reserve the right to cancel Your Appointment and no refund will be given. If You attend Your Appointment more than fifteen (15) minutes late, and have informed Us of Your late attendance in reasonable time, Your Therapist may still see You for the remainder of Your Appointment time slot. However, this is entirely at the discretion of Your Therapist and Your Therapist is under no obligation to do so.

A-therapist and Your Therapist are not required to send You any additional notifications or reminders, or contact You in any way to remind You, of Your scheduled Appointment(s). It is, therefore, Your responsibility to ensure that You attend Your scheduled Appointment(s) on-time or inform A-therapist, or Your Therapist directly, as soon as possible if You are running late, or can no longer attend. It is also Your responsibility to ensure that any other person(s) responsible for attending Appointments are aware and agree to these Terms.

If the Therapist taking an Appointment is delayed, You, or the person(s) attending the Appointment, will be notified as soon as possible via email, telephone or SMS/WhatsApp (as appropriate). The Therapist may have the availability to extend Your Appointment time slot to compensate for any time lost due to the delay. If this is not possible, or the Appointment times are no longer convenient, You, or the person(s) attending the Appointment, will have the option to reschedule the Appointment.

Telehealth Appointments

It is possible that a technical issue may arise during an Appointment(s) delivered via teletherapy. You, or the person(s) responsible for attending the Appointment, are responsible for ensuring that any perceived technical and connection issues are resolved as far as possible prior to the Appointment commencing, and to maintain adequate connectivity, including audio and visual quality, throughout the Appointment. If technical issues arise as a clear fault of Your Therapist's service and connectivity, or due to unforeseen and unavoidable circumstances, You will be given the option to reschedule Your Appointment once the issue has been resolved. If the issue is unable to be resolved, You will be given the option, if a Clinic is within reasonable distance, to attend Your Appointment in-person. You will receive a refund for this Appointment, and any remaining Appointments, if they have to be cancelled due to no alternative Service available or suitable. You may be offered a partial refund, or, when possible, an extended Appointment time slot to account for the lost time, in the affected or an upcoming scheduled Appointment, if the technical issue was apparent in only part of Your Appointment.   

All A-therapist Services, regardless of the mode of service delivery, are grounded in the most evidence-based research and best practice principles to ensure all therapy needs are met and at the highest possible standards. You, however, have the right to request a different service delivery model at any time throughout treatment. However, A-therapist is under no obligation to change the service delivery of any booked Service. Amending a service delivery for booked Appointment(s) is entirely at the discretion of Your Therapist when considering suitability and adherence to standards of best practice, and/or A-therapist availability of facilities and individual Therapist availability.

Fair Usage

We operate a ‘Fair Usage Policy’ which means we reserve the right to refuse to provide Services to anyone who, at A-therapist’s discretion, does not use the Services ‘fairly’. Unfair use of the Services may include but shall not be limited to the following:
- What We deem to be excessive use the Services; and/or
- Persistent cancellation or rescheduling of Appointments; and/or
- Persistently not turning up for Appointments; and/or
- Exhibiting offensive, aggressive or inappropriate behaviour or using offensive or inappropriate language, either to Our staff or within the Clinic

If A-therapist, at Our sole discretion, deem You to have behaved in a way or used the Services in a way that is not consistent with our Fair Usage Policy we may refuse to continue providing You with Services and any booked Appointments may be cancelled. You can appeal any such decision via Our complaints process.

Referrals

Should the Therapist taking Your Appointment consider a referral appropriate, they may offer to refer You to an appropriate professional or provide guidance on how You may be able to self-refer. A referral may be an ‘open referral’, which will not specify the name of a specific professional, just the nature of the referral (e.g. this client is being referred to an audiologist for a hearing assessment); or a ‘named referral’ to a specific professional of Your choosing, or as recommended by Your Therapist.

Professional Affiliations

All A-therapist Speech and Language Therapist’s are registered members of the Royal College of Speech and Language Therapists (RCSLT) and the Health and Care Professions Council (HCPC). A-therapist is also a member of the Association of Speech and Language Therapists in Independent Practice (ASLTIP). All of Our Therapist’s have an enhanced disclosure from the Disclosure and Barring Service (DBS) pertaining to their chosen field of expertise (working with paediatrics, adults, or both). Each Therapist is registered with the DBS update service which consistently maintains the Therapist’s most up-to-date DBS records. The Therapist’s consent must be given before others are able to check the Therapist’s DBS status online. A-therapist is registered with the Information Commissioner’s Office (ICO).

 

Complaints

If You wish to raise a complaint regarding Services, please first speak to Your Therapist directly, or contact A-therapist via email at complaints@a-therapist.com. Please provide as much detail as possible regarding Your complaint so that We will be able to resolve the situation promptly and efficiently.   

A-therapist Privacy Policy / Data Protection

We will process your personal information in accordance with all applicable data protection legislation, including the General Data Protection Regulations (GDPR), and Our confidentiality obligations. You agree that the personal information that You, or other people, provide to Us will be processed in accordance with our Privacy Policy.

 

You agree that A-therapist may access, preserve, and disclose details provided by You on the Website: (a) for the purpose of providing the services to You; (b) for the purpose of administering Your account in accordance with the standard operating procedures of A-therapist; and (c) if required to do so by law or in the good faith belief that any such access, preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce this EULA; (iii) respond to claims that any Services violate the rights of third-parties; (iv) respond to Your requests for customer service; or (v) protect the rights, property, or personal safety of A-therapist, its users and the public.

Use of Cookies

This Website uses cookies for record-keeping purposes. A-therapist has two primary uses for cookies:

  1. to identify a user's preferences

  2. to track website usage trends and patterns

This helps Us to improve Our understanding of the needs of Our users’ and to also improve the Website. While both of these activities rely on the use of cookies, You have the option of disabling or refusing the cookies via Your web browser preferences. By using this Website, You agree that We can place these types of cookies on Your device. Additional information about A-therapist use of cookies and Your rights are contained in Our full Privacy Policy.

Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in this Website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

A-therapist provides You with a limited licence to download and access the site subject to the Terms of this EULA. You may not print off any copies or downloadable extracts of any page(s) from our site for any reason. You may view the site content for Your personal reference and You may draw the attention of others who may also benefit from the information and resources posted on Our site.

You must not modify copies of any downloaded materials or resources in any way, and You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of any materials and resources on Our site must always be acknowledged.

You must not use a piece of material or resource on Our site for commercial purposes without obtaining a licence to do so from Us or our licensors.

If You print off, copy or download any part of this site in breach of this EULA, Your right to use this Website will terminate immediately and You must, at Our preference, return or destroy any copies of the materials or resources You have made.

Use of Website Charges

There is no subscription fee to use this Website. All Services are subject to the particular payment terms and conditions which are part of the ordering and payment process.

Use of Website and Associated Services Termination

The licence granted under this Agreement remains valid until terminated by A-therapist or by You. Your rights to use this Website will terminate automatically and without notice if You fail to comply with any of the Terms or with other applicable terms, rules or regulations of A-therapist relating to the use of this site or to the use of any A-therapist Services. Upon termination of this Agreement, You shall cease all further use of this Website and destroy all copies, information or aspects of this site which is held by You and You shall cease to access this site. A-therapist reserves the right at any time to discontinue, withdraw, modify or terminate the site and associated Services without notice and without liability to You.

Limits Of Liability

This Website allows you to book Services with A-therapist. We have used reasonable care and skill in collating and assembling the content and materials but make no warranty as to the accuracy of any information and do not accept any liability for errors or omissions contained in the information on this site. The material displayed on this site is provided without any guarantees, conditions or warranties as to its accuracy.

To the extent permitted by law, A-therapist, and any third parties connected to Us, hereby EXPRESSLY EXCLUDE:

ALL CONDITIONS, WARRANTIES AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED BY STATUTE, COMMON LAW OR THE LAW OF EQUITY.

Any liability for any direct, indirect or consequential loss or damage incurred by any user of A-therapist Services, or user in connection with this website or in connection with the use, inability to use, or results of the use of A-therapist Services or this site, any websites linked to this site and any materials posted on it, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, are hereby excluded.

This does not affect Our liability for death or personal injury arising from Our negligence, nor Our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Subject only to the above provisions of this ‘Limits of Liability’ section, in no event shall our total liability to You for any one event or series of related events exceed the sum of 100% of the total amount paid by You for the Services giving rise to the liability in the 12 months preceding the first incident out of which the liability arose.

All A-therapist Services and Products are underpinned by substantial research and evidence-based practice. However, results from Speech and Language Therapy are never guaranteed and can be impacted by many factors. Therapy efficacy is dependent on, and not limited to;

- Age of the individual requiring therapy treatment

- Severity of the communication disorder

- Type of communication disorder

- Frequency and consistency of therapy sessions

- Ability to practise outside of therapy sessions

- Underlying medical conditions

- Support from caregivers

- Client motivation and commitment to their therapy treatment

 

Therefore, A-therapist makes no guarantees that You, or a Client receiving Services, will achieve any specific results or desired outcomes from attending Appointments or in receiving any other Services or Products. In agreeing to these Terms, You agree not to hold A-therapist, or any A-therapist clinicians, liable for any unsatisfactory results from any Appointment, Service or Product, at any time, under any circumstance.

Unforeseen Circumstances and Events Outside of Our Control

We are not responsible for events that are out of Our control or unforeseen circumstances. If the Clinic is closed or the running of Services is affected by an event outside Our control or an unforeseen circumstance then We will contact You as soon as possible if You have an Appointment scheduled to let You know and We will take steps to minimise the effect of the event or circumstance. Provided We do this, We will not be liable for short-term closure or disruption caused by the event or circumstance in question (‘short term’ means 30 days or less). However, if there is a risk of long term closure or severe disruption to Services at Your Clinic or Services delivered online via telehealth (‘long-term’ means in excess of 30 days), We will look to find you an alternative Service either via online telehealth or at one of our other Clinics, assuming there is another facility within a reasonable distance from Your Clinic and there is Therapist availability on site. Such alternative placement is strictly subject to availability. If an alternative placement is not available, suitable or possible, You may contact Us to receive a refund for any sums you have paid in advance for Appointments that You have been unable to attend due to the long term closure or severe disruption.

Suspending In-person Services

We may have to suspend in-person Services for any reason, including but not limited to: changes to regulatory requirements imposed by the Health and Care Professions Council (HCPC) or the Care Quality Commission (CQC).


Where possible, We will contact You in advance if You have an Appointment scheduled to inform You of Services being suspended, and try to find You an alternative Service either via online telehealth or at one of our other Clinics, assuming there is another facility within a reasonable distance from Your Clinic and there is Therapist availability on site. If the issue is urgent or there is an emergency this may not be possible. If we have to suspend the affected Services for longer than 14 days You will be entitled to a full refund for any Appointments already paid for that You have been unable to attend due to the suspension.

No Misuse or Export of this Website

You may not copy, modify, transmit, attempt to unlawfully post content or export this Website or any associated content or Services. By using this Website, You represent and warrant that You are located in a territory where You are permitted to access and use this site without limitation.


Viruses, Hacking and Other Offences

You must not misuse this Website by introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this site, the server on which this site is stored or any server, computer or database connected to this site or to any of the information which is collected and stored via this site. You must not attack this Website in any way. By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990.

A-therapist will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use this Website will terminate immediately.

A-therapist will not be liable for any loss or damage caused by a denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, devices, programs, data or other proprietary material due to Your use of this site or to Your downloading of any material posted on it, or on any website linked to it.

You may link to this Website, provided You do so in a way that is fair and legal and does not damage Our reputation or take advantage of it, but You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists.

Parties to the Contract

Only You and We have any rights under this Contract. This Contract is between You and Us. No other person shall have any rights to enforce any of its terms.

Separate Clauses

If a court finds any part of this Contract illegal, unlawful or unenforceable, the remainder of this Contract will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are illegal, unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

Enforcing the Contract

If We delay in enforcing this Contract, or any term of it, We may enforce it later. If We do not insist immediately that You do anything You are required to do under this Contract, or if We delay in taking steps against You in respect of any breach by You of this Contract, that will not mean that You do not have to do those things or can prevent Us taking steps to enforce Our rights at a later date.

Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to this Website and the Services, although We retain the right to bring proceedings against You for breach of these conditions in Your country of residence or any other relevant country. This EULA and the Agreement are governed by English law.

Variations

We reserve the right to amend the Contract and these Terms and Conditions at any time. If We make any substantial changes to the Contract then We will publish such changes on Our Website or notify Service Users via email. You are expected to periodically check these Terms and Conditions to take notice of any changes made by Us, as they are binding on You. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere within A-therapist. It is Your responsibility to ensure You have read and understood the contents of this Contract each time You use any of A-therapist Services.
